The lawsuit alleging Eaton and several truck manufacturers deliberately conspired to use only Eaton transmissions in their vehicles will proceed. Check The Roemer Report December, 2011 news item:

Think again, even though the defendants had filed motions to dismiss the complaint against them, the Eaton Corp., along with several major truck manufacturers are out of luck in seeking the dismissal. In a lawsuit against the manufacturers, a U.S. District Court judge has ruled that there is enough evidence against the truck manufacturers to show that they have violated the Sherman Anti Trust Act by conspiring with Eaton to use only Eaton transmissions. This action has forced all other major manufacturers out of the truck transmission market and has allegedly resulted in higher prices and less innovation in the truck transmission market. The Sherman Act protects against contracts or combinations that “unreasonably restrains trade.”
